Any new product sold by a professional to a consumer in France benefits from the legal guarantee of conformity for 2 years from its delivery. This protection concerns complete systems, tanks, faucets, bases, plinths and accessories, whether sold with the fountain or separately. Manufacturers' commercial warranties add to this protection without being able to reduce it.
The legal guarantee applicable in France
For a sale made between a professional and a consumer, the seller is responsible for defects of conformity under the conditions provided for by articles L. 217-3 et seq. of the Consumer Code.
The legal warranty may cover a manufacturing defect, a product not corresponding to the description, a wrongly announced incompatibility, a leak resulting from a defect, or incorrect installation caused by insufficient instructions. It does not cover normal wear, normal saturation of a filter, breakage caused by impact, a fall, excessive tightening, lack of maintenance or use contrary to the instructions.
Faucet, base, plinth and accessories: they also benefit from the 2-year legal guarantee of conformity when sold new to a consumer. A manufacturer's commercial warranty of 6 months or 1 year may be added, but it never reduces this legal protection.

- Presentation of dated proof of purchase.
- Defect in material or workmanship under normal use.
- Product or component recognized as defective after inspection.
Main commercial exclusions
- Normal wear, filter saturation and periodic replacement.
- Fall, shock, neglect, mishandling or broken filter rod.
- Freezing of a still wet filter.
- Use of salt water or water from a softener when it clogs the elements.
- Modified product, unintended use or failure to follow instructions.
- Cleaning with an unauthorized product or method.
To remember: The durations of 1 year and 6 months are manufacturer's commercial guarantees. They do not end the 2-year legal guarantee of conformity owed by the seller.

- Purchase direct from Monderma Water Filters or an authorized dealer.
- Warranty reserved to the original retail purchaser and is non-transferable.

- Coverage for defects in materials or workmanship during normal use.
- Product or component recognized as defective after inspection by after-sales service.
Main commercial exclusions
- Normal wear and parts that have reached their replacement deadline.
- Improper use, accident, negligence or damage caused by the user.
- Product modified or repaired by an unauthorized third party.
- Using salt water or water from a softener when it clogs the filters.
- Freezing of a still wet filter element.
- Excessive tightening, poor assembly, or failure to follow assembly instructions.
- Cleaning the filters with soap, detergent or an unauthorized product.
Monderma stainless steel system: 2-year commercial guarantee on the tanks and the lid, in addition to the 2-year legal guarantee of conformity.
Commercial guarantee and EVA support conditions
Conditions and checkpoints
- Present proof of purchase indicating the date the fountain was received.
- Check the tanks, accessories and consumables upon opening the package.
- Quickly report any damage linked to transport, missing parts or apparent anomalies, with photographs of the product and packaging.
- Do not install or use a filter or accessory with visible breakage or anomaly before contacting after-sales service.
- Normal saturation of cartridges and filter media does not constitute a defect.
- The small bubbles visible in a blown glass tank are a characteristic of the artisanal process and not, in themselves, a defect.
- Breakage caused after receipt by an impact, a fall, excessive tightening, poor assembly or inadequate maintenance is not covered.
- Fountain maintenance must follow the instructions in the EVA booklet.
To remember: the 2-year EVA commercial guarantee concerns the tanks, excluding filtration accessories and consumables. Filters and accessories must be checked upon receipt. These commercial conditions apply without prejudice to the legal guarantee of conformity owed by the seller.

Frequently asked questions
Does the 2 year legal warranty apply to the faucet, base and accessories?
Yes. When they are sold new to a consumer, whether included with the fountain or purchased separately, they can benefit from the legal guarantee of conformity for 2 years. However, normal wear and tear, accidental breakage or damage caused by poor installation are not defects in conformity.
Is a filter automatically guaranteed for 2 years?
The filter benefits from the legal guarantee for an initial defect or abnormal failure. On the other hand, its saturation, its normal wear or its replacement deadline do not entitle you to a free replacement.
Does a filtration duration of 6, 12 or 18 months correspond to a guarantee?
No. This is a duration of use or a replacement deadline. The warranty relates to a product defect, and not to normal consumption of the filter media.
Is a broken part always excluded?
No. A part received broken, damaged during transport or weakened by a manufacturing defect must be examined. On the other hand, breakage caused by a fall, shock or poor handling is normally not covered.
Who should manage the legal warranty: the seller or the manufacturer?
The legal guarantee of conformity is owed by the professional seller. The manufacturer's commercial guarantee may provide for an additional procedure, but it does not replace the consumer's rights against the seller.
Can return costs be charged?
When the legal guarantee of conformity applies, compliance must be carried out at no cost to the consumer. A separate commercial warranty may provide its own terms, without reducing any mandatory legal rights.
